Privacy Policy & User Agreement

WE'VE UPDATED OUR PRIVACY POLICY & USER AGREEMENT to align ourselves with the European Union’s General Data Protection Regulations, which go into effect on May 25, 2018. Although these changes are required by European law, we think that data privacy and security are an important element of websites’ user-experience and that GDPR represents a new standard for handling users’ data. 

Here’s what our Privacy Policy does: 

  • Our updated privacy policy is meant to provide transparency around what types of information we collect about you; how we acquire and use your information; how long we keep it; and your rights to control it. 
  • Our updated privacy policy now includes an e-mail address to our Privacy Policy Coordinator, who will be the point of contact for requests, changes or questions about how your data. 

The following Privacy Policy & User Agreement summarizes the various ways that OPERA NEWS and The Metropolitan Opera Guild treat the information you provide as a result of using or visiting our websites, digital products and platforms, including, but not limited to, operanews.com, metguild.org or any digital replicants or extensions of our publications, including podcasts, social media pages and profiles. 

This Privacy Policy does not cover information collected elsewhere, including offline and on sites, applications, destinations, or services linked to from the our websites and services that we do not control. 

We are committed to actively protecting the privacy and personal information of visitors to Opera News and the Guild’s websites. We have prepared this policy statement so you will be aware of what information is collected about visitors to websites, digital products and platforms and how that information is used. From time to time, our practices may change necessitating changes to the policy as it exists now. We encourage you to refer back to this page to see the policy in effect at the time of your use and, if you wish, change your user preferences.

User Agreement

Purchasing tickets or a subscription, or accessing any of our websites, digital products and publications, or communicating with us by e-mail — including without limitation any registration, purchase or enrollment on any aspect of our websites, digital products and platforms — will constitute your agreement to our User Agreement and Privacy Policy as in effect at the time of your use.  

If you do not agree with the terms and conditions of this User Agreement and Privacy Policy, you may not access, visit and/or use our websites, digital products or publications and you must immediately exit our websites and/or digital platforms.  

Continued access of our websites, digital products and platforms by you will constitute your acceptance of any changes or revisions to the User Agreement and Privacy Policy. If you breach, violate, fail to follow, or act in a way that is inconsistent with the rules, restrictions, limitations, terms and/or conditions that apply to the our sites and/or properties, we may terminate, discontinue, suspend, and/or restrict your account/profile, your ability to access, visit, and/or use our sites and/or properties or any portion thereof, including without limitation any of our purported obligations hereunder, with or without notice, in addition to our other remedies. In addition, we may curtail, restrict, or refuse to provide you with any future access, subscription, visitation, and/or use of our sites and/or properties. We reserve the right, in addition to our other remedies, to take any technical, legal, and/or other action(s) that we deem necessary and/or appropriate, with or without notice, to prevent violations and enforce the User Agreement and remediate any purported violations. By visiting our websites, digital products and platforms, you acknowledge and agree that we have the right hereunder to an injunction without posting a bond to stop or prevent a breach or violation of your obligations under the User Agreement. In the event of any conflict or inconsistency between the terms and conditions of this Privacy Policy & User Agreement, and any rules, restrictions, limitations, terms and/or conditions that may be posted at various points on our websites, digital products and platforms or otherwise communicated to users, we shall determine which rules, restrictions, limitations, terms and/or conditions shall control and prevail in our sole discretion, and you specifically waive any right to challenge or dispute such determination.

Among other things, this User Agreement governs all text, articles, photographs, images, graphics, illustrations, creative, copy, artwork, video, audio, music, podcasts, trademarks, trade names, service marks, and other brand identifiers, designs, plans, software, source and object code, algorithms, data, statistics, analysis, formulas, indexes, registries, repositories, and all other content, information, and materials (collectively, “Content”) available on or through our sites and/or properties, whether posted, uploaded, transmitted, sent or otherwise made available by us, our licensors, vendors, and/or service providers, or by you, and/or other users or third parties, including any such content uploaded manually or bookmarked by you and/or other users.

What Types of Information About You Do We Collect?

Personally Identifiable Information  

The Personally Identifiable Information referred to in this statement of our Privacy Policy includes, but may not be limited to, names, addresses, telephone numbers, e-mail addresses, and credit or debit card numbers, or payment information. Our websites will only collect Personally Identifiable Information about you with your explicit knowledge and consent. When you use our websites, digital products and platforms, we may also acquire your IP address, user ID, password, and/or Unique Device ID, which certain jurisdictions consider to be Personally Identifiable Information because it could be used to identify an individual or device if it were combined with other identifying information. 

Sensitive Personally Identifiable Information 

In certain situations, such as when purchasing tickets or a subscription, you may provide a credit or debit card number, or payment information, which we further qualify as Sensitive Personally Identifiable Information. 

We generally do not request on or through our websites, digital products and platforms information that is often considered “highly sensitive,” such as other financial account information (for example, credit report information, bank account numbers), personal health information, or government issued identification numbers (for example, social security number, drivers’ license number, or passport number).

Anonymous Information

You can browse our our websites and digital platforms without logging on, and no Personally Identifiable Information about you or your visit will be collected. Some of the data that we acquire is anonymized, statistical information about you, your online behavior and your computer, mobile or other device. This information, in the form of “access logs,” allows us to make our properties more useful to you and others who use them by, for example, tracking the features or areas of the site that are most frequented by visitors. None of this information is retained or used in such a way that could be used to identify, distinguish or trace you on your device, even if combined with other identifying information. Some data that could be considered Personally Identifiable Information when combined with other anonymous identifying information will never used in a way that identifies, distinguishes or traces you or your device, but is instead used in an anonymous way that will likely be aggregated with other anonymous user data. The information collected may include: the make, model, settings, specifications (e.g., CPU speed, connection speed, browser type, operating system, device identifier) and geographic location of you and/or your computer, mobile or other device, as well as date/time stamp, IP address, pages visited, errors encountered, time of visits, content viewed, ads viewed, the site(s), application(s), destination(s), and/or service(s) you arrived from, and other clickstream data.

How We Acquire Your Data 

You Provide Some Data 

We mostly receive Personally Identifiable Information about you because you provide it to us when you engage with our products. For instance, when you purchase a ticket, subscription, complete a survey, enter a contest, or register and/or set up an account/profile, you may be provided, or required to choose, a password and/or User ID, and you may provide a credit, debit, or payment account number, or other payment information, as well as your name, telephone number(s), email and/or street address. Other data such as your age, gender, and preferences may also be requested. In addition, we may acquire information about you when you contact us by telephone, postal mail, social media interaction or messaging (e.g., email, SMS, MMS, or similar technologies). We also may acquire information that you provide about other people, for example, when you use our “refer-a-friend” email feature, share content  or purchase one of our products as a gift.

Some Data Is Automatically Collected 

Our websites, digital products and platforms may automatically collect data about you, your online behavior and your device. The data collected may include, without limitation, the make, model, settings, specifications (e.g., CPU speed, connection speed, browser type, operating system, device identifier) and geographic location of you and/or your device, as well as date/time stamp, IP address, pages visited, time of visits, dontent viewed, ads viewed, the site(s), application(s), destination(s), and/or service(s) you arrived from, and other clickstream data. Our websites, digital products and platforms may also collect your data even if our websites, digital products and platforms are not open on your device or you’re not logged in.

Some Data Is Acquired Elsewhere 

We may also acquire Personally Identifiable Information or other data offline or otherwise outside of our websites or platforms. For example, we may purchase or acquire such data from third-party data suppliers. We reserve the right to merge or co-mingle this other data with your Personally Identifiable Information and data collected on or through our websites and platforms. 

Social Network Integration and Third-Party Services  

If you choose to access, visit and/or use any third-party social networking service(s) that may be integrated with our websites or platforms, we may receive personally identifiable information and other information about you and your computer, mobile or other device that you have made available via those services, including information about your contacts on those services. For example, some social networking services allow you to share content from our websites, digital products and platforms to your contacts or to pull information about your contacts so you can connect with them on or through our websites, digital products and platforms. Your decision to use a social networking service in connection with our websites, digital products and platforms is entirely voluntary and no portion of our products necessitate a connection with a third-party social networking service. However, you should make sure you are comfortable with the information your third party social networking services may make available to the Metropolitan Opera Guild and Opera News by visiting those services’ privacy policies and/or modifying your privacy settings directly within those services. We reserve the right to utilize all personally identifiable information and other information about you and your computer, mobile or other device that we receive through third-party social networking services in the same ways described in this agreement as all of your other information.

Please Use Discretion When Posting Personally Identifiable Information to Public Areas of Our Sites 

Please be aware that content, comments and personally identifiable information that you disclose in publicly accessible portions of our websites, digital products and platforms (for example, blog comments or in “Standing Room”) will be available to other users, and may also be made available outside our websites, digital products and platforms by third parties. You should be mindful of all Personally Identifiable Information that you may wish to post.

How We Utilize Your Data

Your Requests for Products and Services

We use your data to process your request for content, subscriptions, merchandise, tickets and/or other product(s). When a user of our websites buys a ticket, purchases a subscription, or requests a brochure or other material, we must have the information necessary to process the transaction. That may include, in certain contexts, your name, postal address, zip code, email address, telephone number, and, when applicable, credit card number or payment information. For example, if you subscribe to Opera News or purchase a ticket to a Guild event, we may use your e-mail address or other personally identifiable information to send you a confirmation notice and/or your mailing address to deliver the publication. If you enter an online sweepstakes, we will use this information to notify you if you are a winner. We may also use the information to communicate with you about new features, products or services, and/or to improve the services that we offer by tailoring them to your needs.

When you purchase a subscription, tickets, register for certain services, set up an account/profile, and/or use certain portions of our websites and services, you may be provided or required to establish a user ID and password. All such information shall be referred to in this Privacy Policy as your “Registration Credentials.” Anonymized Registration Credentials, not containing any personally identifying information, may be securely transmitted to third-party vendors and services authorized by Opera News and the Metropolitan Opera Guild in order to provide users access to digital extensions and/or platforms, such as digital replicants and digital editions. By purchasing an applicable subscription and/or registering on our website, users assent to the secure sharing of these anonymized Registration Credentials for the sole purpose of providing access to additional platforms or extensions of Opera News or the Guild’s services.

Administering the Service 

We also use your data for any lawful business purpose in connection with administering additional access to our websites, digital products and platforms, including without limitation for customer service, to help diagnose problems with servers, to improve products that we offer by tailoring them to your needs, to gather broad demographic information, to analyze trends, to seek compatible advertisers, sponsors, clients and customers, and to track users’ movements around our websites, digital products and platforms and elsewhere on the web or across apps and/ devices. Geographic location data you provide may specifically be used to show you content (including advertising and sponsored messaging) based on geographic location.

In addition to using identifying data to fulfill your requests, process your transactions or to award prizes, users may also select to provide your name and contact information so that it may be added to our database, and we may perform statistical analyses of user behavior to measure interest in the various areas of our websites and/or digital platforms.

Access by Third Party Providers 

We may allow access to our database by third-party vendors that provide us with services that may include technical maintenance, research, circulation management and access to digital extensions of our brand, but only for the purpose of and to the extent necessary to provide those services. If you choose to purchase tickets, products, a subscription and/or services, including without limitation content, on or through features on our websites, digital products and platforms, your information may be directed through third-party vendors for services such as credit/debit card or other payment processing, order fulfillment, credit pre-authorization, and address verification. We actively seek to limit the amount and direction of information that is provided to third parties. For example, subscription purchases are transacted via an approved, third-party vendor or circulation agent, but at no point is card data or payment information transmitted to an organization other than the Metropolitan Opera Guild or Opera News: rather it is transacted by a vendor in situ, with registration information then being transferred via commercially reasonable security measures to our websites and/or digital platforms.

There are also times when you provide information about yourself to us in areas of our websites or platforms that may be managed or participated in by third parties. In such instances, we take every step to ensure that information is transmitted securely when conveyed to and from third party vendors and we require third-party vendors to follow appropriate privacy policies. While we will not authorize them to use your data except for the express purposes for which it is provided — and we take steps to ensure that at no point will that information be shared with any organization(s) other than Opera News or The Metropolitan Opera Guild — we do not bear responsibility for any actions or policies of third parties. Third-party vendors transacting subscriptions or ticket purchases on behalf of Opera News and the Metropolitan Opera Guild may retain user data and personally identifiable information for an indeterminate — but not indefinite — period of time, contingent on their need to maintain accurate business records and transaction data, but at no point will that information be shared with any organization(s) other than Opera News, The Metropolitan Opera Guild or affiliated organizations. 

Marketing Communications 

We may also use your data to communicate with you about new features and special offers from Opera News, The Metropolitan Opera Guild, its partners, subsidiaries, and affiliates and carefully selected companies who we think may offer services and/or products that may be of interest to you. You may also to elect to receive direct mail or telemarketing calls from the Guild or its affiliates about programs, products, and publications. We sometimes make names and addresses available to select organizations for direct mail marketing purposes, but only users who have explicitly opted-in to hear from us or affiliated organizations at the time of purchase, subscription or registration may be contacted. We do not provide our lists to any organizations for e-mail or telemarketing use. 

If you do not wish to have your personally identifiable information shared with third parties, or have any concern that your information is being shared without your consent, contact our Privacy Policy Coordinator, whose contact information can be found near the bottom of this document.    

Health, Safety, and Legal Requests 

We reserve the right to access, use, and share with others your data for purposes of health, safety and other matters in the public interest. We may also provide access to your data in order to cooperate with official investigations, legal proceedings, proceedings brought by or otherwise involving governmental and/or law enforcement officials, as well as private parties, including, for example, in response to subpoenas, search warrants, court orders, or other legal process. We may also provide access to protect our rights and property and those of our agents, customers, and others including to enforce our agreements, policies, and terms of use. 

Employment Opportunities 

If you provide personally identifiable information to us in connection with an employment inquiry or application, without limiting the applicability of the rest of this Privacy Policy, please be aware that we will use your data to evaluate your job application, and for related recruiting, reporting and record-keeping purposes. We may maintain your data on file, whether we hire you or not, to administer your relationship with us and/or for job applicant related reporting and record-keeping for as long as required or permitted by law.

Combining Your Anonymous Data with Personally Identifiable Information 

We reserve the right to merge or co-mingle anonymized, statistical or non-personally identifiable data about you, your offline and online behavior, and/or your device (including its geographic location), with your personally identifiable data for any lawful business purpose.

Sharing Your Data for Marketing; Opt-Out; How to Update Your Data

Credit/Debit Card and Payment Account Data 

We will never sell or rent your your credit/debit card number or payment account data. We may transfer such data to third-party vendors who need access to fulfill a transaction, such as a ticket or subscription purchase. This data will be transferred in a way that utilizes commercially reasonable security measures. 

Sharing Your Data for Marketing 

If you opt to share data with us, unless otherwise specified on our websites, digital products and platforms, we may sell or share your data among our subsidiaries, affiliates, related organizations and with other third parties who we think may offer or enable you to become aware of products that may be of interest to you. 

How to Opt-Out of Sharing for Marketing

If you do not wish to have personally identifiable information such as your name, email address or phone number shared with third parties for their marketing purposes — or have any concern that your information is being shared without your consent — contact our Privacy Policy Coordinator, whose contact information can be found near the bottom of this document. This option to opt-out applies only to personally identifiable information, and not anonymous or anonymized data.

Please note that that, in order for us to properly administer access to our websites, digital products and platforms, we must continue to share your data with third-party providers as described above in “Access by Third Party Providers” under the heading “How We Utilize Your Data.” If you object to such sharing, you should not access our websites, digital products and platforms and you may not purchase tickets or subscriptions through our websites, digital products and platforms. If you request the removal of any personally identifiable information, note that doing so may result in the suspension of service and/or access to our websites, digital products and platforms and or events for which you may have already purchased tickets and/or access and you may not be entitled to a refund for unused services, products, tickets, subscription access or content.

How to Opt-Out of Marketing Messages from Us 

If you do not wish to receive future marketing, commercial messages or notifications of new  products, features and special offers from Opera News and The Metropolitan Opera Guild, simply follow the unsubscribe instructions contained within the message you receive. Note that you may continue to receive certain processing or administrative communications from us — such as transactional or relationship messages, messages about your account/profile, renewal notifications, invoices, technical notices, updates, security alerts and support bulletins — that are necessary to provide access to our websites, digital products and platforms.

Updating Your Personally Identifiable Information 

If you have registered on any part of our website, digital products and platforms, please use the respective mechanism or contact information that allows you to change or update your subscription or purchase preferences, if available, to keep such data accurate and up to date. If no such  mechanism or contact information is apparent or available on the service, contact our Privacy Policy Coordinator as described below with your requested changes.

Cookies and Related Technologies; Do Not Track (DNT) 

Cookies/Local Device Storage 

Our websites, digital products and platforms may at times place and/or store code or cookies (alphanumeric identifiers), locally shared objects and HTML5 on your hard drive (Local Device Storage) or within your browser. These cookies and related technologies allow us to administer access to our websites, digital products and platforms and for our systems to recognize your browser’s access privileges and to personalize your session with us. (For example, you must have cookies turned on to place items or tickets in your shopping cart, to access certain Subscription Content on Opera News or to access other content, e.g., “Standing Room”). 

Cookies and related technologies may also be utilized for other lawful business purposes, including without limitation to determine whether you have seen a particular advertisement before on the same or different device and to otherwise control the display of ads; to track the movements of individual users through our websites, digital products and platforms and elsewhere on the web or across apps, devices, and geographic locations; to help diagnose problems with servers; to gather broad demographic information; and to conduct research.

You Can Turn Off Local Device Storage 

If you do not want cookie(s), code, locally shared objects and HTML5 generated by our websites, digital products and platforms to be stored on your computer, you may be able to adjust the settings on your browser and computer accordingly. Please be aware that disabling local device storage options may limit the range of features that may be available for your use on our websites, digital products and platforms and some portions may not function properly as a a result. 

Tracking Technologies 

In addition to Local Device Storage of cookies, code, locally shared objects and HTML5, we may use web beacons, web bugs, internet or pixel tags, clear gifs, digital fingerprinting (i.e. “Machine Identification”) and similar technologies (collectively, together with Local Device Storage) for lawful business purposes, including to determine which of our messages have been opened by recipients so we can gauge the effectiveness of marketing campaigns, to control the display of ads, to track usage patterns and behavior of users, and your geographic location, to help diagnose problems with our servers, to gather broad demographic information, to analyze trends, to conduct research, to deliver editorial content, to record registration and personalization information, and to otherwise administer our websites and/or digital platforms. We will take every step to utilize this information in an anonymized way that is independent of any identifying, personal information that may be associated with registration on our websites and/or digital platforms.  

Do Not Track (DNT) 

Your browser or computer settings may allow you to opt out of third-party tracking on by automatically transmitting a “Do Not Track” (DNT) signal to websites, digital products and platforms that you visit. There is little useful consensus among the advertising, marketing and technology industries as to what “Do Not Track” means in this context. Some browsers automatically apply DNT signals by default and therefore do not necessarily reflect our visitors’ choice as to whether they wish to receive advertisements tailored to their interests. As a result, like countess other websites and online services, we do not currently support any browser based Do Not Track (DNT) settings or participate in any DNT frameworks, and we do not assign any meaning to any potential DNT track signals you may send or alter any of our data collection or use practices in response to such signals. You may opt out of third-party behavioral advertising  on our website or platforms at any time. Online Behavioral Advertising (OBA) and How to Opt-Out of OBA 

How OBA Works 

We and our third-part providers will occasionally use tracking technologies for purposes of “online behavioral advertising” (OBA). OBA allows the serving of advertisements tailored to interests you have shown by browsing our websites, digital products and platforms, as well as other sites, applications, destinations, and services, using the same or a different device. To enable OBA, we and these third-part providers use tracking technologies to collect largely anonymized data including for example the make, model, settings, specifications (e.g., CPU speed, connection speed, browser type, operating system, device identifier) and geographic location of your device, as well as date/time stamp, IP address, pages visited, time of visits, content viewed, ads viewed, the site(s), application(s), destination(s), and/or service(s) you arrived from, and other clickstream data. The use of tracking technologies by third-part providers is subject to their own privacy policies, not this Privacy Policy, and we have no responsibility or liability in connection therewith.

Opting-Out of OBA 

If you do not wish to receive online behavioral advertising, you may be able to opt-out by visiting http://www.aboutads.info, http://www.networkadvertising.org, http://www.youronlinechoices.com/uk/ and/or by clicking the “Ad Choices” icon that appears in advertising served through OBA. Please note that the option to opt-out applies only to tracking by third-party providers across our websites, digital products and platforms, and other sites, applications, destinations, and services. Opting-out of online behavioral advertising does not not limit tracking among pages within our own websites, digital products and platforms. Residents of the European Economic Area (EEA) and Switzerland have additional options as described below to exercise choices with respect to OBA.

Transfer of Your Data Among Jurisdictions 

The Metropolitan Opera Guild is a United States-based company. Your data and personally identifiable information may be transferred to, and maintained on servers and databases located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as your jurisdiction. Your consent to this User Agreement & Privacy Policy followed by your submission of such information represents your consent of any such transfer. If you do not wish to have your information transferred to, and maintained on, servers and databases located outside of your state, province, country or other governmental jurisdiction, please contact our Privacy Policy Coordinator, whose contact information can be found near the bottom of this document. Please note requesting the removal of your data may result in the suspension of service and/or access to our websites, digital products and platforms and or events for which you may have already purchased tickets and you may not be entitled to a refund for unused services or products. 

Data Security and Notifications 

Security Measures 

We take the security of our customers seriously and we have enacted commercially reasonable security measures to protect against unauthorized access to, or unauthorized alteration, disclosure or destruction of, personally identifiable information that you have shared with us.

No Liability for Breach 

No data transmission can be guaranteed to be completely completely secure, and no system of physical or electronic security is impenetrable. Therefore, we are unable to guarantee the absolute security of the information you send to us or the security of our servers, networks or databases. By using the our websites, digital products and platforms you agree to assume all risk in connection with the information sent to us or collected by us when you access, visit and/or use our website and platforms, including without limitation your personally identifiable information or other Registration Information. We assume no responsibility for any loss of such information or the consequences thereof.

Moreover, if you elect to store information, such as your personally identifiable information or other Registration Credentials, where others may access it, we may not be held liable for any loss of such information or the consequences thereof. If you lose a computer, mobile or other device, or a device is stolen that contains your personally identifiable information or other Registration Credentials, it is up to you to take all the steps necessary to secure your information and data.

Breach Notification 

In the unlikely event that we believe the security of your data or personally identifiable information in our possession or control may have been compromised, we will seek to notify you within a 72 hour window. If notification is appropriate, we may notify you by e-mail, push notification, or otherwise.

Notice to California Customers: Your Privacy Rights 

Shine the Light

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the business’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Alternately, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties’ direct marketing purposes if the customer has exercised an option to opt-out of such information-sharing. We have such a policy in place. If you wish to opt-out of our sharing of your information with third parties for the third parties’ direct marketing purposes or to find out more about your opt-out rights, please contact our Privacy Policy Coordinator as described below.

Online Erasure

California’s “Online Erasure” law, Business and Professions Code Sections 22580-22582, requires operators of certain websites and online services to allow registered users who are under the age of 18 and residents of California to request removal of content they post. If you live in California and are under the age of 18 and have posted content on a section of our websites, digital products and platforms that is accessible to minors, you may request removal of the content by contacting our Privacy Policy Coordinator as described below.

Notice to Residents of the European Economic Area (EEA) and Switzerland 

Purposes of Processing 

As explained above, we may process your data to administer your requests for subscriptions, tickets, products, generally administer our websites, digital products and platforms, facilitate access by third-part providers, provide marketing communications, facilitate legal requests, respond to your requests in connection with employment opportunities, and to combine data sets. As explained above, we may also use, transfer and otherwise process data acquired from you directly or by use of tracking, for marketing purposes, including to serve you with Online Behavioral Advertising.

Legal Basis for Processing  

We serve you with Online Behavioral Advertising with your consent, and you have the right to withdraw consent at any time as described above, by contacting our Privacy Policy Coordinator described below. We rely on the legitimate interest basis of processing for other activities described in our Online Behavioral Advertising section because: certain data is necessary to provide you with our products and to respond to your requests; our activities are reasonably expected by our visitors; and those activities do not unduly and negatively affect the privacy rights of our visitors.
